400 Record is a 17-story, 235,000-square-foot property located in downtown Dallas, epitomizing luxury in an office setting. The building features unparalleled amenities ranging from a private fitness center to first-class dining, stylish conference rooms, on-site security, and striking views of downtown Dallas.

Building Security

Building Access

A card access control system has been installed at 400 Record for the convenience and safety of our Tenants. The access control system provides controlled access to the Market Street entrance during the day, night, weekends, and holidays. In addition, closed circuit TV monitors after-hours entrances to the Building.

After Hours Building Access

The Management Office will issue Access Cards programmed for controlled access. Authorized entry will be limited to the Building and to the specific floor(s) on which the Tenant is located. Forms for ordering Access Cards are included in the Forms & Important Documents Section. It will be the responsibility of the Tenant to notify the Management Office of the loss, termination, or reassignment of Cards to ensure proper control for access to the building. Tenant will be charged a replacement fee for lost or damaged cards based on the then published rate.

During periods when the Building is closed, an Access Card must be used to enter the building and activate the elevators. Tenants are asked to ensure that all doors are secure when they enter or exit the Building after hours. To exit the building, press the red exit button located on the wall beside the door.

After Hours Elevator Access

To use the passenger elevators after hours, pass the Access Card over the reader panel. If entry is authorized, a small green light will flash and/or you will hear a beep. You will have approximately five seconds to select your floor by pressing the desired floor button. The elevator will then take you to your floor. When leaving your floor to exit the Building, press the down button in the elevator lobby to summon a car. Upon arrival of a car, step inside, and press the Lobby Level button. After hours, the elevators will only stop on the Lobby Level unless you use your Access Card to access another authorized floor(s).

Do not allow other people to enter the Building by following behind you as you use your access card! Those Tenants with access cards have been approved by their companies to be in the Building after normal business hours. Other people in the Building without access cards are either in the Building without the consent of their companies or they are trespassing.

Deliveries

The building is located at 400 S. Record Street. The four streets that surround it are: Record, Young, Market & Wood Streets. It is located near Reunion Tower and across the street from the Omni Hotel, The Dallas Morning News Building, and the WFAA Building.

The building has a small loading zone located on Wood Street and the underground loading zone is located next to the trash compactor on the B2 level of the parking garage. The entrance to the underground loading zone is on Market Street at Wood Street. The garage clearance is twelve (12) feet. Semi-trucks and trailers will not fit in the garage, even if they are flat beds because they will not be able to make the turns inside the garage.

The underground loading zone is limited to 15 minutes unless prior arrangements have been made with building management (Cushman & Wakefield). If you have been scheduled for a delivery, iidon Security will grant access into the vestibule where you will need to ride the elevator to the first floor. You must check in with iidon Security. After you have done this, they will lock off the freight elevator for your use during the delivery. When you have finished with the delivery, the freight elevator must be returned to iidon Security.

Elevator Size & Care: The freight elevator’s dimensions are: door opening 41.5”, interior 6’ x 6’, height 9’, door to freight elevator room 40” wide by 106” tall. The freight elevator also serves as a passenger elevator when not in use as a freight elevator so the finish in the elevator is upgraded to passenger standards and not freight standards. If you have large equipment or dollies, you will need to install the freight elevator pads and provide Masonite to protect the granite floor. The Wood street entrance lobby doors are all glass and shatter very easily. The dimensions of the glass doors in the lobby are 5’10” wide and 8’6” tall.

A certificate of insurance listing 400 Record Street and Cushman & Wakefield as additional insureds must be provided to Cushman & Wakefield prior to the delivery. A sample certificate is attached from Cushman & Wakefield.

Emergency Procedures

Fire

Upon discovering a fire, you must immediately:
A. Rescue – Remove anyone from the immediate area. This means the room of origin or immediate vicinity of the fire. This is not an evacuation of the premises.

B. Confine – Close the door to the room of origin. This will act to contain the fire and smoke to that one room for a long period of time.

C. Alert
1. Call the Dallas Fire Department at 911 and give the following information:

  • Nature of the emergency: Fire, Medical, etc.
  • Your name
  • Complete street address: 400 S. Record Street, Dallas, Texas 75202
  • Building Name: 400 Record Building
  • Floor number and suite number
  • Closest street intersection: Market Street and Wood Street
  • Call back number (do not stay on the phone if you are in danger)

2. Call the building management office at 214-744-9790 and give them the following information:

  • Your name
  • Nature of the problem: Fire, Medical, etc.
  • Floor number
  • Suite number
  • Telephone number you are calling from.

D. Fight – If the fire is small and confined to one object (such as a trash can), locate the appropriate fire extinguisher for fighting that type of fire and use it. However, never attempt to fight a fire unless: 1) you know how to operate the fire extinguisher equipment; 2) you have the appropriate type of extinguisher; 3) the fire is small; 4) you have access to an exit if you fail to put the fire out.

  1. Hand held extinguishers are located on each floor inside the stairwells
  2. How to operate the extinguishers: pull the pin, aim the nozzle or hose at the base of the fire, squeeze the handle, and sweep from side to side, aiming at the base of the fire

No elevators are to be used for emergency evacuation of personnel, unless ordered by the fire department or building management.

I. Fire Safety Volunteer Responsibilities
A. Fire Warden Responsibilities
The Fire Warden shall direct, enforce and have full charge of the evacuation of all personnel in his/her assigned suite during any emergency. Fire Wardens will be assisted in their duties by designated Assistant Fire Wardens or others that may be required or designated.

In addition, the Fire Warden should be constantly assured of the following as it concerns his/her assigned area:

  1. Each suite will have one or several persons responsible for checking out their particular areas in case of fire or bomb threat, and then they will report their findings to the Fire Warden.
  2. Check all aisles, corridors and exit doors and keep free from any type of obstruction.
  3. All fire extinguishers, fire exit signs, hoses and other safety appliances are to be ready for use. Any defects should be reported to the 400 Record Building Management Office.
  4. Be aware of all duties of the people who assist you.
  5. In the event of fire, execute the fire safety plan and:
    • Determine the location of the fire, call 911; notify the Building Management Office at 214-744-9790.
    • Notify all suite occupants of the fire.
    • Direct the evacuation of the suite to the designated point.
    • Follow the instructions of the fire department.
    • Prevent the use of elevators unless otherwise instructed by the fire department.
    • Select the safest stairway to use for evacuation.

B. Assistant Fire Wardens Responsibilities
The Assistant Fire Warden will assist the Fire Warden in the areas that he/she needs assistance. In cases where the Fire Wardens are not present, the Assistant Fire Warden will assume the Fire Warden’s responsibilities.

  1. Locate the EXIT doors. Never prop doors open, keeping them closed prevents smoke from entering.
  2. Direct traffic in the exits and on the stairway.
  3. Keep traffic moving steadily to avoid panic.
  4. After the evacuation, doors should be closed.

C. Fire Alarm System

  1. How alarm system is activated:
    • Manual pull stations
    • Smoke detectors/heat detectors
    • Water flow/tamper alarms on the sprinkler system
  2. What is activated in an alarm condition/examples:
    • If it is the “fire” floor — speakers (sirens) and strobes throughout the floor, along with the floors above and below will all be activated. The speakers will make a “WOOOP, WOOOP” sound.
    • Elevators are recalled to the ground floor.
    • Turns off heating, ventilating and air conditioning system (HVAC) on the fire floors.
    • Automatically unlocks all stairwell doors in the building to the permit re-entry onto other floors if smoke is encountered in the stairwell.

II. Fire Detection Emergency Procedure
General Procedures
DO

  • Follow Floor Warden’s instructions.
  • Shut all doors to the fire area.
  • Use portable fire extinguisher, if possible.
  • Proceed to stairwell.
  • Evacuate the fire area/your floor — see Building or Floor Evacuation Procedure section below.
  • Gather at the designated area.

DON'T

  • Unless it is a small fire, do not attempt to extinguish fire before calling the Fire Department or the Management Office.
  • Use elevators.
  • Panic.
  • Return to the building until the building representative or DFD has given the “ALL CLEAR.”

Smoke – Odor Detected
DO

  • Call the Management Office immediately at 214-744-9790.

DON'T

  • Pull fire alarm station if you only smell smoke — Engineering and Security Officers will investigate the odor immediately.

Smoke – Visible
DO

  • Call Fire Department at 911.
  • Call Management Office at 214-744-9790.
  • Pull alarm.
  • Proceed to stairwell.
  • Evacuate the fire area/your floor
  • Gather at designated area.

DON'T

  • Use elevators.
  • Panic.

III. Building or Floor Evacuation Procedure
General Procedure
It is the responsibility of each employee to know who their company emergency Fire Warden is as well as their alternates. They should also be familiar with their respective evacuation plans.

All decisions to evacuate the Building will be made by the Fire Safety Director or in his absence by a member of the Management Staff until the Fire Department arrives and takes over all operations.

DO

  • Follow the instructions of your individual company Fire Warden or assistant.
  • Close the doors of your office as you leave but do not lock.
  • Fire Wardens check each office, restrooms, storage areas etc.
  • Form an evacuation line — two abreast.
  • Use the Stairwells to evacuate the Building. Stay to the right.
  • Keep talking to a minimum.
  • Use hand rails in the enclosed stairwells.
  • Listen for instructions and follow them.
  • Keep calm.
  • Pay special attention to disabled and injured persons — see Building or Floor Disabled Evacuation Procedure below.
  • Evacuate to the ground floor and exit out of the building.
  • If stairwell is blocked, then enter a safe hallway and proceed to the other stairwell located in the building.
  • If both stairwells are blocked by fire or smoke, return to an office or room and close the doors. Call the Fire Department (911), and building management (214-744-9790) and notify them of your location. Seal doorway openings and air conditioning vents with towels, clothing, etc. Stay low, below the smoke and
  • use a wet towel to cover your mouth and nose. Break windows only as a last resort.
  • Once evacuated from the fire area/your floor, verify that all your employees are accounted for by meeting in a designated area.
  • Once all employees are accounted for the Fire Warden for each suite is to notify Building Management.

DON'T

  • Go to the elevators — they will not respond.
  • Once you have left your area, do not return for coats, purses, etc.
  • In stairwell, watch out for Building personnel or Fire Department coming up stairwell to handle emergency.
  • Be ready to merge with other people evacuating the Building.
  • Run or create a panic.
  • Return to the office until "all clear” announcement is given by the Fire Department or Building authority.

IV. Building or Floor Disabled Evacuation Procedures
Each Tenant should insure that the names of all Disabled Individuals are listed with the Building Safety Director in the Management Office.

For the Physically & Visually Disabled

  1. A "Buddy" or "Buddies" should be assigned to assist each disabled individual in the event of an emergency.
  2. The "Buddy" should insure that each disabled individual is moved safely to the Building stairwell.
  3. Ask the person the best way to help them.
  4. If necessary, gain assistance from a co-worker and move the disabled individual down the stairs by using carrying techniques.
  5. The "Buddy" should stay with the disabled individual until emergency personnel arrive.

Lists with the names of all Disabled individuals at the 400 Record Building are kept in the Fire Control Room and the 400 Record Building Management Office for the use by Fire Department personnel.

V. General Fire Prevention Safety Rules
You can help prevent fire in Your Office. Here are some simple rules to follow that will prevent fires at home and at work.

DON'T

  • Empty ashtrays into wastebaskets
  • Smoke or light matches near flammable materials.
  • Overload the electrical outlets.
  • Plug high-voltage items into electrical outlets.
  • Use extension cords.
  • Obstruct aisles, hallways, or Fire Exit doors.
  • Allow office machines and other type of machinery to operate unattended.
  • Burn candles in your work area.
  • Store items closer than 18” from the ceiling and sprinkler heads in the ceiling.

DO

  • Maintain good housekeeping habits within immediate work area.
  • Store flammable materials and liquids in closed metal cabinets. Only minimum amount should be kept in area and handle only in approved safety cans.
  • Obey the Building smoking rules and signs.
  • Check the electric cords on all office equipment periodically.
  • Report all fire hazards or violations to the Management Office at 214-744-9790 immediately.
  • Know the location of the Building fire extinguishers, the fire alarm pull stations, and locations of fire exits on your floor.
  • Provide additional fire extinguishers if specific areas contain hazardous materials/operations.

Bomb Threat

Telephone Procedures for Bomb Threats
If a threatening call is received by an employee, the employee should follow these procedures:

  • Keep the caller on the line as long as possible. Ask them to repeat the message. Record the message in writing word-for-word if possible.
  • Ask the caller to tell you the location of the bomb, its proposed detonation time, outside appearance or description of bomb and reason for placing bomb.
  • Inform the caller that the detonation time of the bomb could result in serious injury to many innocent people.
  • Attempt to get the caller to identify him/her and/or their present location.
  • Pay close attention to background noises which might give a clue to the place from which the call is made.
  • Listen closely to the caller's voice for accents or speech impediments which could be used for possible identification.
  • When caller hangs up, immediately report your information to 911 and then call the Management Office at 214-744-9790. Our Security Office will confirm the contact with the Dallas Police at 911.
  • Complete a copy of the Bomb Threat Call Checklist found in the Forms Section

Evacuation & Search Procedures for Bomb Threats

  • Contact Dallas Emergency Services at 911 immediately after receiving a bomb threat and then call the 400 Record Building Management Office at 214-744-9790.
  • 400 Record Building Security and 400 Record Building Management personnel will immediately contact each tenant in the complex by phone to notify them of the receipt of a bomb threat.
  • As part of our notification, we will ask that each employee search his/her own immediate work for unrecognizable objects or disturbed areas (i.e. ceiling tiles removed). If a suspicious object or a suspicious area is found, it should be reported to the 400 Record Building Management Office at 214-744-9790 and the Dallas Police Department at 911 immediately.
  • A command center in the Lobby of the affected building at the Fire Control Room will be established for communication purposes. Any information regarding suspicious objects may be turned in at this location to 400 Record Building Management personnel or the Dallas Police.
  • If a suspicious object is found DO NOT move, jar or touch the object in any way. DO NOT cover the object.
  • Tenant contacts will make their own determination as to whether they and their employees should vacate the building. In most cases, Building Management will not order an evacuation in a bomb threat situation.
  • If a suspicious object is found, Dallas Police (or other governmental agencies) will coordinate a search of the building(s) upon arrival at 400 Record Building.
  • If nothing suspicious has been found, tenants will be notified by way of the building(s) public address system. It will be up to the Tenant Contact to determine their company’s position on returning to their suite.

Severe Weather

When the Management Office is notified of a severe weather alert, an announcement will be made through the public-address system for the entire building. In the event of a Severe Weather Alert (tornado or high winds), please observe the following procedures:

  1. Employees should stay away from all areas of glass, such as windows and glass lobby doors.
  2. With the help of the Fire Wardens, move all employees to the center of their respective floors away from the building perimeter and exterior glass.
  3. Employees should leave their exterior offices and close those doors.
  4. Sit down in corridor and protect yourself from any kind of flying glass. This can be done by putting your head as close to your lap as possible, or kneel protecting your head.
  5. Do not evacuate the Building unless instructed by the Management Office.

If you are in transit in the Building:

  1. Take the nearest stairwell for shelter.
  2. Do not go to the first floor lobby, or outside the building.

If you are caught in an outside perimeter office:

  1. Seek protection under your desk.

Civil Disturbance

In case of civil disturbance, the following plan of action will be followed:

  1. Management Office will dispatch Building Security Officers or a Patrol Security Officer to the scene of any civil disturbance to identify the situation, secure the location and:
    • Conduct crowd control.
    • Explain the nature of disturbance and threat to 400 Record Building Management.
    • Call 911 (if needed).
    • Work as the center of communication for all parties involved.
  2. The Building Security Officer shall secure the Building and monitor all traffic in and out.
  3. The Patrol Security Officer will conduct crowd control and estimate the nature of the disturbances and report all finding to the Management Office.
  4. Management will proceed to the scene and assist in coordinating, control of crowd, evaluate the means to control the situation and evaluate the risks involved.

Medical Emergency

  1. Immediately dial 911 and give the operator the following information:
    • The nature of the emergency
    • Your location (400 S. Record Street, Dallas, TX 75202)
    • Floor number
    • Suite number
  2. Call the Management Office at 214-744-9790 so arrangements will be made to place the elevators on independent service for paramedics.
  3. Do not attempt to remove the victim from the Building.
  4. Make the victim as comfortable as possible

Other Emergency Procedures

A. Power Failure

  1. Call the 400 Record Building Management Office at 214-744-9790 immediately and do not leave your floor.
  2. In the event of a loss in telephone service, 400 Record Building Management will make a sweep of each floor.

B. Elevator

  1. Push the call button. The telephone will automatically dial the alarm monitoring station. This phone is monitored 24 hours a day, 7 days a week. You will need to give the operator:
    • Your name
    • Type of emergency
    • Elevator number (above the intercom call box)
  2. Don't panic. Remain calm. The worst part of your entrapment will be a short delay.
  3. Do not try to force the elevator door open.
  4. Passengers will be assisted as soon as the elevator company technician arrives.

C. Picketing

  1. Picketing on the public streets in and around the 400 Record Building complex is allowed as long as it is done in a peaceful manner on public property. Under no circumstances is picketing allowed on the grounds and private property of 400 Record Building.
  2. Setting up facilities or accommodations by picketers will not be allowed on our property.
  3. Signs are not allowed to be posted on the property.

Building Services

Air Conditioning and Heating

The Building's standard room temperature is approximately 74 degrees. With normal operation, the thermostatic controls are designed to maintain actual room temperatures in the range of 72 to 76 degrees. Please do not change the thermostat settings in your suite. They are set at the Building's standard temperature to regulate the temperature so that it is comfortable for the majority of our Tenants. Should you experience uncomfortable temperature levels in your suite, please call the Management Office to determine if the temperature is outside of the building standard range.

Janitorial and Day Porter Services

Custodial services are performed in all Tenant and public areas. Your office will be cleaned five days each week. This service includes all normal cleaning such as dusting, emptying wastebaskets, vacuuming, etc. Should you have a special cleaning request, please contact the Management Office and we will be glad to log your request in our Work Order System, which is reviewed nightly by the janitorial supervisor. Tenants will be billed for any above standard cleaning.

Mail Service

The Management Office assigns suite numbers and postal lock box numbers. The Post Office requires that each Tenant has an assigned box and that this lock box number be included as part of the Tenant address. The Postal Lock Box Order Form can be found in the Forms & Important Documents Section.

The mail facility is located on the first floor off the service corridor from the loading area. Mail is delivered and picked up at that location according to the posted schedule. All outgoing mail must be placed in the depository located in the mail pick up area for the US Post Office to handle. The US Postal Service main number is 1-800-275-8777

Maintenance and Service Requests

Any construction, service (carpet cleaning, extra window cleaning, etc.), or repair work, as well as the contractors performing such work, must be approved in writing by the Management Office. If the work is not done by Landlord and Landlord deems that supervision is necessary, a management fee will be charged by Landlord which is payable by the Tenant. To request service, please contact the Management Office.

All major construction must be approved by the Cushman & Wakefield Management Office. Please refer to section titled Requirements for Tenant Performed Construction for detailed information regarding our construction requirements. IMPAK

400 Record has introduced the IMPAK technology platform for the property. IMPAK is a web-based platform that will allow you to request services, reserve property amenities, review important building documents, and receive building news and information online at the property website.

As a valued tenant of the property, you will have access to sections of the website that the general public will not, therefore you, as the Tenant Contact, will be issued a login name and password. This information should be kept confidential. The assigned password can be changed on the site. You will be notified of your login name and password shortly after you have moved into your new offices.

Building Amenities

Building Card Key Access

The building utilizes an access system with card access and Closed Circuit cameras. The building is open from 8 AM to 6 PM Monday through Friday and 8 AM to 1 PM on Saturdays. After hours, Sunday and Holidays the building is secured and an access card is needed to enter the building and to use the elevators.

Parking Garage

The parking garage has three levels with a total of 208 parking spaces available to the tenants. The first level has 60 executive parking spaces and two handicap spaces. The second level has 65 reserved parking spaces and two handicap spaces and the third level has 77 parking spaces and two handicap parking spaces.

Toll Tag Parking

The parking garage entrance can be entered by access card or by toll tag. Access into the garage is by management approval and card activation only. The access system at the garage entrance and at the Lubben lot entrance has the ability to activate toll tags to read and raise the gates. The toll tag reader is a major convenience to our tenants because it allows the tenants to pull up to the gate and the gate raises as their tag is read.

Tenant Socials

Social Events are planned every year which gives the Management Team the opportunity to meet all our tenants and let our tenants know that we appreciate them. We maintain a more personable level with the tenants here at 400 Record and we look forward to ice cream socials, coffee and donuts, and holiday events at 400 Record.

ATM Machine

An ATM machine is conveniently located in the first floor lobby. Our tenants have quick access to cash whenever they need it.

Outside Smoking Area

A designated smoking area is available to smokers. The area is on the mezzanine level and is easily accessible from the building. The area includes a bench and an ashtray so smokers can relax and unwind.

Bullion Restaurant

Bullion is a French brasserie with a modern twist that is located on the mezzanine of the lobby. The restaurant has a full bar with predominantly French wines, charcuterie, and cheeses. Chef Bruno Davaillon is the Chef de Cuisine and specializes in traditional French fare.

The restaurant is open from 11 AM to 10 PM Monday through Friday, with a simplified mid-day menu between 2 and 5 PM, and 5 to 10 PM Saturdays.

Bullion To Go

A convenient café is located on the first floor of the building. Hot meals, sandwiches, and breakfast are available Monday through Friday from 7 AM to 4 PM. Weekly specials are offered every day and feature soups, sandwiches, breakfast items, and assorted pastries.

Second Floor Conference Center

The conference center is made up of four large conference rooms and a central lounge area. The rooms can host up to 336 people at one time by raising the movable walls for unique meetings. Flat screen TVs are displayed in every conference room for viewing and presentation capabilities. A catering kitchen is located just down the hall from the conference rooms. The catering kitchen includes a refrigerator, ice maker, and sink for catering working lunches. Bullion, the on- site restaurant, can cater coffee and breakfast meetings, working lunches, or full day workshops.

Fitness Center

A complimentary full-service gym and locker room with towel service is available for use by all Tenants. The gym has an extensive collection of cutting edge equipment and locker rooms for your convenience. Each locker room is equipped with three marble showers and spa-grade amenities.

On-Site Car Wash

A premier auto detail and car wash is located on site for your convenience. They provide one-on-one personalization, catering to your vehicle’s needs, because you deserve to drive a clean car every day.

Delivery Services

Policies & Procedures

Building Rules and Regulation

  1. Sidewalks, doorways, vestibules, halls, stairways, and similar areas shall not be obstructed. Nor shall refuse, furniture, boxes or other obstructions be placed in any passageway by Tenant or by any Tenant Related Party.
  2. Canvassing, soliciting, and peddling in the Building are prohibited.
  3. Plumbing fixtures and appliances shall be used only for the purposes for which constructed, and no unsuitable material shall be placed in any of these Facilities.
  4. No signs, directories, posters, advertisements, or notices shall be painted or affixed on or to any of the windows or doors, or in corridors or other parts of the Building, except in such color, size, and style, and in such places, as shall be first approved in writing by Landlord in its discretion. Building standard suite identification signs will be prepared by Landlord at Tenant's expense. Landlord shall have the right to remove all unapproved signs without notice to Tenant, at the expense of Tenant.
  5. Landlord shall have the power to prescribe the weight and position of heavy equipment or objects which may overstress any portion of the floor. All damage done to the Building by the improper placing of such heavy items will be repaired at the sole expense of the responsible Tenant.
  6. Tenant shall notify the Building manager when safes or other heavy equipment are to be taken in or out of the Building, and the moving shall be done after written permission is obtained from Landlord on such conditions as Landlord shall require.
  7. All deliveries must be made via the service entrance and service elevator and after normal business hours, if possible. Landlord's written approval must be obtained for any delivery after normal business hours.
  8. Tenant shall cooperate with Landlord's employees in keeping its leased premises neat and clean.
  9. Tenant shall not cause or permit any improper noises in the Building, or allow any unpleasant odors to emanate from the leased premises, or otherwise interfere, injure or annoy in any way other tenants, or persons having business with them.
  10. No animals shall be brought into or kept in or around the Building, other than those required by disabled persons.
  11. When conditions are such that Tenant must dispose of crates, boxes, etc., it will be the responsibility of Tenant to dispose of them prior to or after the hours of 7:30 AM and 6 PM, respectively.
  12. No machinery or equipment of any kind, other than ordinary office equipment such as personal computers, printers, and telephone equipment shall be operated on the leased premises without the prior written consent of Landlord, nor shall Tenant use or keep in the Building any flammable or explosive fluids or substances (including Christmas trees and ornaments), or any illuminating materials. No space heaters or fans shall be operated in the Building. No open flame of any kind is permitted within the building.
  13. No bicycles, motorcycles, or similar vehicles will be allowed in the Building.
  14. No nails, hooks, or screws shall be driven into or inserted in any part of the Building except as approved by Building maintenance personnel.
  15. Landlord has the right to evacuate the Building in the event of an emergency or catastrophe.
  16. No food and/or beverages shall be distributed from Tenant's office without the prior written approval of the Building Manager.
  17. No additional locks shall be placed upon any doors without the prior written consent of Landlord. All necessary keys shall be furnished by Landlord, and all keys shall be surrendered upon termination of this Lease, and Tenant shall then give Landlord or his agent an explanation of the combination of all locks on the doors or vaults. Tenant shall initially be given two (2) keys to the leased premises by Landlord. No duplicates of such keys shall be made by Tenant. Additional keys shall be obtained only from Landlord, at a fee to be determined by the Landlord.
  18. Tenant will not locate furnishings or cabinets adjacent to mechanical or electrical access panels or over air conditioning outlets so as to prevent operating personnel from servicing such units as routine or emergency access may require. Cost of moving such furnishings for Landlord's access will be for Tenant's account. The lighting and air conditioning equipment of the Building will remain the exclusive charge of the Building designated personnel.
  19. Tenant shall comply with parking rules and regulations as may be posted and distributed from time to time.
  20. No portion of the Building shall be used for the purpose of lodging rooms.
  21. Prior written approval, which shall be at Landlord's sole discretion, must be obtained for installation of window shades, blinds, drapes or any other window treatment of any kind whatsoever. Landlord will control all internal lighting that may be visible from the exterior of the Building and shall have the right to change any unapproved lighting, without notice to Tenant, at Tenant's expense.
  22. Tenant shall provide plexiglass or other pads for all chairs mounted on rollers or casters.
  23. Landlord reserves the right to rescind any of these rules and make such other and further rules and regulations as in its judgment shall from time to time be necessary or advisable for the operation of the Building, which rules shall be binding upon Tenant upon delivery of written notice to Tenant.

Conference Center Rules and Regulation

When using a conference room located on the second floor, the following Policies and Procedures shall be agreed to and observed by Tenant and their guests for the mutual safety and convenience of all tenants in or going to and from the 400 South Record Street building.

  1. No Smoking shall be permitted in the Conference rooms, restrooms, waiting area, or any place in the tower. Please use smoking area located across the street.
  2. Cleaning of any carpet stains from consumption of food or beverages in the room shall be charged to Tenant. No alcoholic beverages are permitted in the Conference room unless prior written approval is received from the Property Manager.
  3. No signs, placards, banners, notices or other written material shall be set-up, affixed to or painted on the walls of the Conference Rooms, doors to the Conference Room, or elevator lobby by Tenant, its employees, agents or invitees without prior written approval from management.
  4. The Conference Room shall not be used to vend, peddle or solicit orders for sale or distribution of any merchandise, device, service, periodical, book, pamphlet, or other items for merchandizing.
  5. The Conference Room shall not be used as storage space for any equipment or property belonging to Tenant other than what is necessary during their reserved meeting time. Such equipment shall be removed promptly when the meeting is over.
  6. Landlord will not be responsible for personal property, equipment, money, or jewelry lost or stolen from the Conference Room or public areas in the lobby.
  7. The room must be returned to the pre-meeting layout. Normal vacuuming dusting and trash removal is provided with no charge. Above normal cleaning or repairs will be an additional charge.
  8. The Tenant using the Conference Room shall not permit any loud noises or other sounds from the room that might be disruptive to other tenants or clients.
  9. The Conference Center is furnished with Internet service, a telephone line with polycom conference phone, A/V equipment, WI-FI service is available. Out-bound long distance calls are not permitted. A lounge is located on the northeast side of the second floor, and includes refrigerator, microwave, and ice maker.
  10. Tenant is responsible for notifying the Management Office of the caterer’s name and delivery information (via the Conference Room Reservation Form). Caterer also must have a certificate of insurance. (Obtain sample from the Management office).
  11. Tenant will fill out the Conference Room Reservation Authorization form, and return the signed Authorization before the reservation can be considered confirmed. Reservations made without a signed Authorization will not be held past four (4) days.
  12. Any cleaning beyond standard vacuuming, dusting, and trash removal will be charged at $20.00/hour. Special carpet cleaning required for spills and stains will be charged as billed by vendor. Room inspections shall be made prior to and post each meeting. Any damages incurred during the meeting will be charged back to the Tenant.
  13. Security officers requested by tenants will be charged at a rate of $35.00/hour/officer.
  14. Landlord will have the right to refuse reservations to any group or tenant and reserves the right to amend, modify or supplement these Rules and Regulations as in the Landlord’s judgment may be necessary for the safe, convenient and efficient use of the Conference Rooms.

Fitness Center Rules and Regulations

  1. All persons (“Users”) that wish to use the Fitness Center on the 2nd Floor of the 400 Record Building located at 400 S. Record Street, Dallas, Texas 75202 (the “Building”), must read and agree to abide by the rules and regulations contained herein prior to gaining access to the Fitness Center.
  2. The Fitness Center is strictly for the use by the employees of tenants in the Building who have completed, signed and dated the Fitness Center Release and Waiver of Liability forms. Visitors, contract employees, family members, relatives and guests are not permitted to use the Fitness Center. Users may not permit access to the Fitness Center to other persons or loan their access cards to another person for any reason. Violations of this rule will result in a termination of a User’s Fitness Center privileges.
  3. Users must be 18 years of age or older.
  4. Users who use the Fitness Center will be doing so at their own risk. 400 S. Record Street, LLC, a Texas limited liability company (the “Landlord”), and Cushman & Wakefield of Texas, Inc., a Texas corporation (the “Property Manager”), are not responsible for any injury that may occur to the Users during or arising out of any exercise activity or use of the Fitness Center. Landlord will not provide any supervision for the use of the Fitness Center. Users are advised and encouraged to consult a physician before beginning any exercise program.
  5. Access will be granted through Property Manager’s office located on the 2nd Floor of the Building. The charge for a replacement access card is $35.00.
  6. Any personal injuries, accidents, damaged equipment or wet/dangerous surfaces should be immediately reported to the Property Manager’s office located on the 2nd Floor of the Building.
  7. The Fitness Center will provide bath towels and hand towels to be used by the Users while working out in the Fitness Center. The towels are not to be removed from the Fitness Center. Any User caught violating this rule will be assessed a fee by the Landlord for replacing the towel. Landlord also reserves the right to revoke a User’s right to use the Fitness Center.
  8. Users shall not consume food or chew gum inside the Fitness Center. Water is provided and Users must provide their own spill-proof containers. Sports drinks are permitted provided they are kept in sealable, plastic containers at all times.
  9. Smoking or use of tobacco products, consumption of alcoholic beverages and use of illegal drugs in the Fitness Center is strictly prohibited at all times.
  10. Appropriate fitness attire and footwear is required at all times. Street clothes (jeans, khakis, etc.), street shoes, sandals and flip flops are not allowed. Appropriate shirts and shoes must be worn at all times in the Fitness Center. Landlord reserves the right to determine what is appropriate fitness attire. For safety reasons, bags, jackets and coats are not allowed in the weight machine or cardio machine areas. Please store all items in the lockers provided in the Fitness Center. Changing into exercise attire must be done in the locker room.
  11. Lockers are provided for use by the Users in the locker rooms, based upon availability. Each User will be responsible for providing a combination or key lock to secure the locker while a User is using the Fitness Center. Lockers may only be used during a User’s use of the Fitness Center and must be emptied upon departure from the Fitness Center. If any locks are left on the lockers, Landlord is authorized to remove the lock and to dispose of any contents in the locker.
  12. Landlord is not responsible for personal items in the Fitness Center or the lockers or for any lost or stolen items. Any personal items left in lockers after operating hours will be considered abandoned and will be disposed of immediately.
  13. Keep hands and feet clear of moving parts while weight machines are in use. Never put hands or feet under the weight stacks. Place hands and feet firmly where indicated.
  14. Outside equipment is not allowed in the Fitness Center. Due to the confines of the Fitness Center, jumping rope is not allowed.
  15. Do not drop weight stacks. Gently lower the weight stacks.
  16. Weight belts are not allowed on weight machines unless the belts do not make contact with the seat or any portion of the equipment.
  17. Radios and other personal audio equipment are not permitted in the Fitness Center unless they are personal units (iPod or mp3 players) equipped with headphones. Please be respectful of others by refraining from cell phone use while in the Fitness Center. If you must take a telephone call, please leave the work-out area.
  18. Users must follow proper fitness etiquette at all times, including:
    • Returning all equipment to the proper location after each use.
    • Wiping down all pads and grips with wipes after use.
    • Sharing equipment. If you are doing multiple sets on a machine, please allow others to use equipment between sets.
    • Practicing appropriate personal hygiene by using deodorant and wearing clean workout clothes.
    • Avoiding the Fitness Center if you are feeling ill or believe you have a contagious illness.
    • Not using profanity or shouting.
    • Using all equipment properly.
    • Respecting posted regulated time limits for using the cardio machines. During periods of heavy use, limit time on cardio machine to 30 minutes.
    • Refraining from physical conduct that is sexual in nature, including unwelcome or consensual sexual advances, requests, comments or innuendoes, sexual jokes, gestures or statements.
  19. All equipment should be used properly and left in good working condition for the next person. Do not operate equipment if it has damaged or loose parts.
  20. Loitering is not permitted in the Fitness Center.
  21. Users will be responsible for the cost of any damages arising from their misuse or abuse of the machines and equipment in the Fitness Center.
  22. Users must comply with all rules and regulations, exercise equipment instructions and safety regulations. Rules and regulations are subject to change and will be posted in the Fitness Center. Abuse of the facility or equipment will not be tolerated. Landlord reserves the right to revoke any User’s use of the Fitness Center if such User does not adhere to these rules and regulations.
  23. Landlord reserves the right to close the Fitness Center at any time and from time to time without notice to Users.
  24. In exchange for the privilege of using the Fitness Center, I agree to pay to Landlord the amounts from time to time charged by Landlord to users of the Fitness Center payable by check quarterly in advance, together with any sales, use or other tax payable in connection therewith (if any). I acknowledge that Landlord will not accept cash, credit card, debit card or any method of payment other than check. I also agree to pay a $35.00 administrative fee for any check returned for insufficient funds or other refusal to honor my check.

Moving Policies and Procedures

At least two (2) weeks in advance, Tenant should contact the Management Office to coordinate the move and reserve the service elevator. Prior reservations take precedence and requests are honored on a first come-first served basis. All deliveries and move-ins/outs must be accomplished after normal business hours. Any large deliveries or moves that must be scheduled after business hours require management approval. For fill list of moving policies and procures, see below.

  1. The Tenant must make arrangements with the Management Office to schedule moves and use of the service elevator. A firm arrival time should be established. In the event that it is necessary for moves to be scheduled outside of normal business hours, a tenant representative must be on site to provide access and supervision to contractor. If supervision is required from Cushman & Wakefield Management (as determined by the Cushman & Wakefield Management Office) a $30.00 per hour fee will be charged to the Tenant.
  2. A Certificate of Insurance for the moving company must be provided and be on file with the Management Office prior to the move. All insurance requirements as stated in the Insurance Requirement Summary section of this manual, must be met.
  3. Clean masonite sections are to be used as runners on all finished floor areas where heavy furniture or equipment is being moved. The masonite must be at least one-eighth inch thick, using 4' x 8' wide sheets in elevator lobbies and corridors and 32" wide sheets through doors and in Tenant's Lease Space. All sections of masonite must be taped together to inhibit sliding.
  4. All walls, door facings, elevator cab and other areas along the route to be followed during the move will be inspected by a representative of the Management Office and moving company/Tenant before and after the move. The moving company must provide and install protective coverings on all walls, door facings, elevator cab and other areas along the route to be followed during the move. If protection is not determined to be sufficient, the move may be suspended until proper protection is in place.
  5. Upon arrival at loading dock, a moving company supervisor or representative must contact Security. After the Security Officer has verified authorization from the Cushman & Wakefield Management Office, approval will be given to the moving company for entry into the building. If move is outside of normal business hours, authorization and access must be arranged in advance through the Tenant.
  6. Any damage to the building or fixtures caused by the move is to be paid for by the moving company or Tenant responsible for the move.
  7. Service Elevator Dimensions:
    • Height: 9'4"
    • Depth: 7'5"
    • Width: 5'8"
    • Weight Capacity: 4,500 lbs.
    • Opening Dimensions: 4' x 7’

Insurance Protection Policy

The Tenant is required to provide the Management Office with proof of valid and current insurance with limits specified by management. A valid certificate of insurance provided by the insurance carrier must be on file in the Building Management Office. (See Insurance Requirements Summary Section for specifics.)

Smoking Policy

The management of 400 Record strives to provide a pleasant working environment for all our valued Tenants. As a result, a No Smoking Policy is in effect throughout 400 Record. Smoking is not permitted in any public area, hallway, restroom, elevator cab, or the building lobby at any time. Smoking is also not permitted outside building entries.

Smoking is permitted only in designated areas. Appropriate receptacles have been provided.

This policy has been established in accordance with the City of Dallas Ordinance Numbers 18961 and 19648. We request all our Tenants, their employees, and guests abide by the policy we have established.
